Three Hopkinsville men accept plea deals in sexual assault case
Three Hopkinsville men have entered plea deals including prison time for charges regarding the sexual assault of a 15-year-old boy in Christian County, Kentucky Attorney General Andy Beshear announced Friday.
The assault happened in October of 2014 at a party in Christian County, the attorney general’s office says. The three men entered pleas this week before Christian County Circuit Judge John Atkins. The attorney general’s office says the plea agreements state that the three sexually assaulted the boy while he was unconscious, which "inflicted serious physical harm" to him.
The attorney general’s office provided pictures of two of the men — 20-year-old Samual Miller and 21-year-old Tyler Perry — in its announcement of the plea agreements Friday. Miller is charged with first-degree complicity to wanton endangerment, complicity to tampering with physical evidence, and distribution of matter portraying a sexual performance by a minor. Perry is charged with first-degree assault.
A picture of the third man was not included in the announcement. 19-year-old Colton Cavanaugh is charged with first-degree sodomy of someone who was physically helpless, first-degree wanton endangerment, and tampering with physical evidence.
As part of the plea deals, each man agreed to testify against the two other men in any court proceedings.
The other terms of the three men’s plea deals, according to the attorney general’s office, are:
Miller: A sentence of 13 years was recommended on all counts, to run consecutively. He must register as a sex offender.
Perry: A sentence of 10 years was recommended, and he must serve 85 percent of that sentence.
Cavanaugh: A sentence of 20 years was recommended on all counts, to run consecutively. He must serve at least 12 years before he is eligible for parole. He must register as a sex offender, and serve five years of parole after he’s released from prison. He also agreed to offer a public apology to the victim as part of his plea.
Final sentencing for Perry and Cavanaugh is scheduled for Nov. 1, and final sentencing for Miller is scheduled for March 7.
Beshear’s office says a fourth man — 22-year-old Dayton Jones — is accused of being involved in the assault, and a jury trial is set for him on Monday in Christian County Circuit Court.
