Charges dropped in fatal Missouri bar shooting

CAPE GIRARDEAU, Mo. (AP) - A southeast Missouri prosecutor has dropped murder charges stemming from a bar fight, saying there isn't enough evidence to take the case to trial.

The Southeast Missourian reports that Cape Girardeau County prosecutors announced Wednesday they were dropping charges against Malcolm U. Harris. He was charged with second-degree murder and armed criminal action following the shooting death of Nicholas Gilbert at The Spot nightclub in Cape Girardeau in December.

A preliminary hearing in the case had been scheduled for Tuesday. Prosecutors say they will refer the case back to Cape Girardeau police for further investigation.
