BENTON, Ill. - A man charged with the murder of a southern Illinois woman wants his statements to police excluded from his trial.

The attorney for 39-year-old Donald Lee told the judge his client's statements relating to the death of Brittany Andrews were obtained improperly.

The judge will make a ruling on those recorded statements during a status hearing October 1.

Prosecutors say Lee talked to police voluntarily.

Lee pleaded not guilty in Andrews' shooting death.

Police found her body behind a flower and card shop in Benton, Illinois in May.

Lee's trial is set to start October 8.
