Shooting at storage unit in Reidland, KY

One man involved in the alleged burglary has been arrested. The other, who was shot at the scene, is dead.

The McCracken County Sheriff's Department says 36-year-old Brandon York has been charged with third degree burglary, possession of burglary tools, possession of methamphetamine and possession of drug paraphernalia. He was jailed at the McCracken County Jail.

The incident the charges stem from resulted in the shooting death of 30-year-old Garlon Casey Cox, of Benton.

The shooting took place at the AAA Mini-Storage facility at 270 Eagles Nest Drive near the Reidland area of McCracken County. Sheriff's deputies responded to a call from 49-year-old Jeffrey Conrad of Benton, who told deputies he arrived at the complex to find two men with a pickup truck stealing from a unit he'd rented.

Conrad told deputies he confronted the men with a .45 caliber pistol, telling them not to move. The sheriff's department said York ran away just as Conrad fired.

The McCracken County Sheriff's Department says Cox had an apparent gunshot wound to the head when deputies arrived on scene, Cox was pronounced dead at 7:53 a.m. Monday at Lourdes Hospital.

Local 6's Juliana Valencia spoke with attorney Mark Bryant on how far you can go legally to protect your property. Bryant said you can use deadly force on someone only if they enter your home or if you or another person is in danger of their life.

“The real issue here is whether you're fearful of serious physical injury or death at the hands of somebody else. If you are, you have a right to use deadly physical force. If you are not, you have a right to use physical force… If he [Conrad] thought that he or someone else in the near vicinity was going to be in danger by their conduct, like trying to run over somebody with a truck, he had every right to shoot them,” Bryant said.

The shooter, Conrad, is not facing any charges. 

Sheriff Jon Hayden said several meetings were held with the Commonwealth's Attorney's Office concerning the shooting death of Cox.
