Fleming Furniture owner pleads not guilty to felony charges

Fleming Furniture owner Dan Kelley entered a not guilty plea on Tuesday to 10 felony charges.

His attorney Mark Bryant told Judge Tony Kitchen that Kelley had made cashier's check to all of the customers listed in the complaint, including about $11,500 made to Merryman House. Bryant says the restitution came out of Kelley's retirement.

The criminal complaint filed on February 5 says Kelley was arrested on 10 felony charges, including seven counts of theft by failure to make required disposition of property over $500, one count of theft by failure to make required disposition of property over $10,000, one count of theft of services over $500 and one count of theft by deception over $500. He was also served two summonses for theft by failure to make required disposition of property under $500. 

The complaint says the charges stem from people buying furniture that Fleming never ordered. 

A preliminary hearing is set for February 25, where Kelley's attorney's will ask to lower Kelley's $22,000 bond.
