Judge in Stanford rape case removed from a new sexual assault case

The judge who handed down the controversial sentence in the Stanford rape case has been removed from a new sex assault case at the request of prosecutors. The Santa Clara Count District Attorney said he feels like the judge is biased. Prosecutors may use a procedure to remove the judge from any sex assault cases in the future.

The dismissal from the new sexual assault case came after Judge Aaron Persky dismissed a misdemeanor stolen mail case mid-trial on Monday. the judge said there was insufficient evidence presented to send this case to a jury. The District Attorney said he is disappointed and puzzled at the judge's decision to dismiss that case before a jury could even deliberate.

The case that Judge Persky was removed from involves a man charged with a felony count of sexual battery for allegedly groping a woman while she was under sedation.
