Tennessee judge says woman has no rights to child in same-sex divorce case

KNOXVILLE, Tenn. (AP) -

A Tennessee judge has ruled that a woman in a same-sex divorce case does not have the legal rights to a child she and her wife have raised because of a 1977 state law on artificial insemination. The old law recognizes mothers and husbands.

The Knoxville News Sentinel reports that Knox County Circuit Judge Greg McMillan ruled Friday that state law says Erica Witt cannot be recognized as a parent.

Erica Witt and Sabrina Witt were married in April 2014 in Washington, D.C. The couple moved to Knoxville, and Sabrina Witt gave birth to a baby girl after being artificially inseminated. Because same-sex marriages were not recognized in Tennessee at the time the child was born, Erica Witt's name was never placed on the child's birth certificate.
