Jury finds Marcellus Phagan guilty of 2nd degree rape, 2nd degree sodomy in McCracken County

MCCRACKEN COUNTY, KY — A McCracken County jury has found a 30-year-old man guilty of one charge of second degree sodomy and one charge of second degree rape of an underage girl.

The trial of Marcellus Phagan began Wednesday. He was charged with two counts of second degree rape and two counts of second degree sodomy. Thursday, he was convicted of one count of each charge.

Phagan was arrested in March 2018 after investigators said he sexually assaulted a 13-year-old girl. Authorities said after he was arrested he told investigators in McCracken County that he had sex with the child.

The jury recommended 10 years in prison for each of the two counts, with the sentences to run consecutively.

The judge will consider the jury’s recommendation at a sentencing hearing at 1:30 p.m. on July 12.
